I discuss the hypothesis that folksonomies could be a useful tool to increase the transparency of the legal system. The essay can be divided in three main parts. In the first section, I introduce the issue of transparency in the context of the legal system through an overview of different opinions outlined by contemporary legal philosophy, thereby confirming the overall formalistic perspective. In the second part, I show how transparency may correspond to the concept of “data sharing” that is achieved in the «many to many» communication through the Internet. In the third, part I analyse the collective tagging system after identifying the key element of Web 2.0 in the sharing of metadata, providing the definition of folksonomies and describing some features of its possible application to legal information management. In conclusion, I suggest that folksonomies could improve legal information management through Internet.},

abstract = {Il lavoro affronta il tema della socialità nel pensiero di Giovanni Ambrosetti (Verona 1915 - Carpi 1985) il quale, adottando un realismo “critico” di matrice neoscolastica, intese superare il positivismo – nelle due versioni empiristica e razionalistica – e contrapporsi alle posizioni di stampo naturalistico ravvisate nello storicismo assoluto e nell’idealismo. L’“ontologia sociale” dell’Autore, composta di “permanenze” o “verità sociali” – le principali sono la famiglia, la proprietà e lo Stato – si esplica in una fenomenologia – definita “diritto naturale cristiano” – nella quale la Filosofia del diritto si coniuga con la Filosofia della storia ed in cui costume, diritto e morale sono riuniti in una visione complessiva che si propone di stabilire una connessione tra ordine naturale, ordine sociale ed ordine interiore all’insegna di una visione sostanziale della giustizia ed in funzione della perfezione spirituale della persona. Lo studio si propone di inquadrare l’argomento nella discussione sul rapporto tra “verità” e “prassi” presente nella filosofia del diritto italiana del Novecento. Il lavoro intende anzitutto verificare in che termini il tentativo di sintesi tra “metafisica classica” e “filosofia dei valori” si inserisca nel diritto naturale classico e costituisca un’alternativa rispetto al giusnaturalismo moderno; in secondo luogo approfondisce i profili critici di tale prospettiva – il rapporto tra essenza ed esistenza, tra ordine e sistema, tra teologia, filosofia e scienza, tra fondamento e fonte dell’ordinamento giuridico, tra costume, morale e diritto – i quali consentono, per un verso, di affermare la straordinaria attualità della figura di Ambrosetti e, per altro verso, di individuare ulteriori percorsi di ricerca.},
