Paper abstract bibtex The issue of the administration of justice almost always requires a dramatic description, and in order to find immediate solutions to the problem, great efforts have to be made. It is what researchers call applied-diagnosis studies. The tendency is to focus on a different way of approaching and understanding the problems. The historic and critical studies of centuries public policies applied in Venezuela the XX an XXI, are helpful to demonstrate how and to what extent the phenomenon has been determined by particular previous legal conditions. For example, (i.e.): Our republican history has been determined by the unstable social, political and economic conditions of the country. All these have contributed to shaping a feeble State which functions in a permanent state of frailty, obliterating the minimal chances for the existence of a Social Welfare State , in spite of the fact, that Venezuela has been one of the countries with the greater petrol revenues in the world
