In fact, the thesis of this Article is that the Constitution should prohibit domestic surveillance of U.S. persons' First Amendment activity in the absence of a reasonable suspicion of criminal activity.Politically motivated investigations are not permissible, since the mission of law enforcement is to enforce the criminal laws, not to monitor political or religious expression. The history and purposes of the constitutional right of association corroborate this conclusion.
