The article presents the analysis of legal expertise in disputes on parenting when parents live separately (65 children and 78 parents). The clinical and psychological factors are discussed that have expert value when inspecting parents for a complex psychological and psychiatric conclusion on the harm done to the mental health and mental development of a child due to his/her stay (communication) with one of the parents. These are the following factors: mental illness, individual psychological characteristics, behavior against a minor, parenting style and parental position. The differentiated approach to assessing the impact of pathopsychological and individual psychological characteristics of a parent on child’s mental state and development in cases of joint and separate residence of a child with a parent is justified. The necessity of an expert examination of a child to assess the parenting capability in parents with a mental disorder is discussed.
